How To Read a Nursing Home Inspection Survey To Identify Abuse or Neglect

All nursing home providers participating in the Centers for Medicare & Medicaid Services (CMS) program must meet Federal reporting requirements as well as state laws as they relate to the Illinois Nursing Home Care Act. Homes must also remain in substantial compliance to remain in operation and be evaluated for care standards through annual surveys and inspections. It is expected that any recorded violation will then be addressed promptly and residents will no longer be at risk from those noted deficiencies.

Families can review a website published by CMS called Nursing Home Compare. Here, they can access quality of care information for every nursing home that participates in Medicare and Medicaid in Illinois. Nursing Home Compare provides an overall star rating based on three factors: health inspections, staffing levels, and quality measures, but also includes the results of recent health inspections.

Reports from WGLT NPR show a COVID-19 outbreak at Bloomington Rehabilitation and Health Care Center had staff and nursing home residents calling 911 on numerous occasions, requesting for urgent help and resident transfers. The home is located at 925 S. Main St. in Bloomington. Illinois Department of Health coronavirus tracking reports show the facility is home to McLean County’s most significant COVID-19 outbreak to date. And the irony? Bloomington Rehabilitation and Health Care Center struggled to provide quality care and adequate staffing even before the virus hit, according to recent government inspections.

On May 1, 2020, the Chicago Tribune posted an article detailing the issues surrounding Alden Estates of Naperville’s handling of the COVID-19 pandemic. The article begins with the experience of Brenda Petty, who called the facility weeks back to check on her mother who was a resident at Alden Estates of Naperville. The facility explained to Petty that her mother was fine and there were relatively few cases of COVID-19 within the facility. However, just three days after this initial phone call, Petty’s mother was diagnosed with COVID-19 and subsequently died, the article continues that Petty did not learn of the true extent of the outbreak in the nursing home until after her mother had passed away. Following similar issues regarding the lack of communication between the facility and the public, the facility’s new administrator sent a letter to families apologizing for the communication issues and declared such problems unacceptable.

On May 28, 2020, the Daily Chronicle posted an article detailing the COVID-19 outbreak at Pine Acres Rehab & Living Center, describing numerous failures in the facility’s fight against the virus and preventing its transmission. The article explains the lack of information being shared by the community to family members who are extremely concerned for the well-being of their loved ones who are residents in the facility. Numerous attempts to receive updates or any kind of information about how the facility has been dealing with the virus outbreak have been met with silence on the part of Pine Acres. The article further cites a report from the Illinois Department of Public Health which stated Pine Acres had not performed the necessary testing on residents until 12 days after it was discovered an employee of the facility had contracted the virus. This inability on the part of the facility to sufficiently test residents demonstrates a major failure on its part in combating the virus outbreak and further preventing its transmission within Pine Acres.

Chicago’s South Shore Minority Community Facing COVID-19 Realities

Illinois long-term care facilities have now contributed to nearly 3,500 coronavirus deaths of residents and workers, according to data published by the Illinois Department of Public Health (IDPH). The fatalities have been linked to nursing homes, assisted living communities, centers for adults with developmental disabilities, and skilled nursing facilities across the state, with hot spots spreading in Cook County, specifically among minority groups battling higher mortality and disability rates as a result of their long-term care system.
