Nursing Home Arbitration Bill Approaches Senate Markup

The nursing home legislation would ban pre-dispute arbitration agreements now widely used by long-term care facilities. The nursing home bill was passed by the House Judiciary Committee in July. At a joint Senate committee hearing witnesses testified that under pre-dispute agreements, victims of nursing home abuse and neglect discussed how they faced a one-sided dispute resolution system with no public record and no appeal. Industry witnesses tried to argue that these agreements are fair to residents. Binding arbitration clauses in nursing home contracts create huge problems within nursing home contracts.
