In connection with the wrongful death of a nursing home resident, the Massachusetts attorney general has recently filed criminal charges against Life Care Centers of America for its abuse and neglect of nursing home residents. The criminal charges against the nursing home are the result of an alarming trend of neglect at the nursing home, culminating in the 2004 death of a resident. The 74 year old resident was a known risk for wandering and for falls, and she was supposed to be equipped with monitors that would sound an alarm and lock doors anytime she got too close to a stairway. Yet, her death was caused by a fall down a flight of stairs. She was not wearing her monitor at the time she fell.
Since the 2004 fall, the Tennessee-based Life Care Centers of America was twice cited by Massachusetts authorities for endangering its residents. In 2006, just two years after the failure to supervise residents with a history of falling that lead to a fatality, the nursing home was fined for failing to monitor a similar patient with a history of falls.
