Levin & Perconti filed a nursing home negligence lawsuit in the Circuit Court of Cook County on behalf of the daughter of a nursing home resident who sustained personal injuries while under the care of Rest Haven South Nursing Home in the Chicago suburb of South Holland, IL. The victim, O.D. Lyons, was admitted to the nursing home for short-term rehabilitation. Rest Haven was aware of O.D.’s risk for falls when he was admitted to the home. He fell three times at the facility and his fourth fall resulted in a hip fracture that required surgery. The nursing home failed to implement the proper precautions to prevent O.D. from falling and fracturing his hip, even though they were aware of his history of falls. O.D. returned to Rest Haven after the surgery and immediately fell from bed. He was once again admitted back into the hospital. After this last fall, his family decided that he must be placed in a better facility. Levin & Perconti filed the case because the nursing home violated their trust by repeatedly neglecting to care for him in an appropriate manner.
