Lawsuit Filed Due to Alleged Nursing Home Neglect

When we leave our parent at a nursing home we expect that the facility will provide the best care possible. Unfortunately, this is not always the case. A man filed a lawsuit in Cook County alleging nursing home neglect in the death of his mother. When a nursing home fails to provide proper care or does not abide by the rules of the Nursing Home Care Act, they may be guilty of negligence. In this instance, the lawsuit alleges that the woman suffered serious pressure sores, pneumonia, sepsis, MRSA, and respiratory problems that ultimately contributed to her death. The lawsuit seeks damages of more than $50,000 and has requested a jury trial.

Signs of Nursing Home Neglect
Nursing home neglect and abuse are all too common an occurrence. In this case, the woman suffered from several problems that point to neglect. Pressure sores should be prevented. When someone has developed pressure sores and they continue to worsen, it is almost always a sign of neglect. Pressure sores can occur when an immobile patient is unable to move on his own and does not receive proper care. Sores develop in areas where the bed linens continually rub against the skin. This happens in areas such as the elbows, heels, and tailbone. The woman in this instance suffered a stage IV sacral wound, the most serious and dangerous kind of pressure sore.

MRSA (Methicillin-resistant Staphylococcus aureus) is a contagious and highly resistant infection that can occur in hospital and nursing home settings. In nursing home patients health care associated MRSA can occur after the patient has had a surgical procedure or has tubes or devices that become infected. MRSA is difficult to treat because it does not respond well to typical antibiotics. It is extremely difficult to treat, especially in the elderly. For this reason, patients with MRSA could suffer deteriorating health and die. The woman in this case contracted MRSA and that contributed to her decline and death.

Nursing Home Neglect Lawsuit
When a nursing home patient is seriously harmed because of neglect, the result can be devastating. While nothing can bring your loved one back, you can and should pursue justice. The nursing home is liable for the medical costs associated with the injury, which may be quite high. Additionally, they may be liable for other damages including money for pain and suffering caused by the negligent act. Most of all, nursing homes need to be made aware that they cannot get away with providing inadequate care to their residents.

Nursing Home Neglect Lawsuit
This lawsuit shows the failures of some of our nursing homes. Nursing homes may have insufficient staff to handle their residents or they may not provide staff with proper training. The management may be lacking or they do not have the procedures in place to take care of some situations. Regardless of the reasons, nursing homes must always fulfill the needs of their patients and when they fall short they are likely responsible for neglect.
