Nursing homes should be safe places, where we can be assured that our loved ones receive the care and support they need in their advancing age. Unfortunately, that was not the case for the family of one elderly man and his family. The family recently filed a lawsuit alleging that the man died as a result of injuries and neglect suffered at two local area nursing homes. The family is being represented by Levin & Perconti and is seeking damages of more than $50,000 in a lawsuit filed in Cook County.
Man Suffered Injuries
The man was injured because of neglectful care at Asta Care Center of Elgin, LLC, and Warren Park Health and Living Center, LLC. The family claims that the man’s health deteriorated significantly while under their care. The man was malnourished, and was found to have been ingesting harmful substances. The care providers failed to properly supervise the resident, which resulted in his severe medical conditions.
The family indicates that their loved one received insufficient care while at the nursing home. The man suffered from some mental decline so he was not able to care for himself. The nursing home was responsible for providing care and supervision as needed. The man was found to be eating substances which were not food items on several occasions. Nursing home staff should have been available to watch the resident in order to keep him safe. Additionally, the man suffered from malnutrition.
Malnutrition is a surprising occurrence in many nursing homes across the country. Malnutrition can occur for a number of reasons. The food may not be appealing to residents, especially those who are on some types of medications. Prescriptions can also cause a lowered appetite, so residents do not feel like eating. Some residents simply do not pay attention to their eating habits and others may be depressed. Many elderly people have dental problems that may make chewing difficult. People may also need help with cutting their food and with the activity of eating itself. Regardless of the reasons, nursing homes are required to ensure that residents are getting the necessary dietary intake.
Lack of Supervision
Malnutrition is a serious problem, especially for the elderly, who already have weakened immune systems. Nutrition problems are a direct result of nursing home neglect. Staff members must supervise every resident. When a person requires additional support and help with eating, it must be provided. Caregivers should be making sure that patients eat what is provided to them.
Malnutrition does not happen overnight. It develops after a long pattern of improper nutritional intake. Thus, it is quite possible that the man suffered for a period of time without properly eating. This is also indicated by the fact that he was eating other items in his room. Nursing homes are legally bound to provide proper care to residents. If they have accepted the person into their facility, they are responsible for ensuring that they get the care they need.
If your loved one was seriously hurt or died as a result of neglect in a nursing home, you may be entitled to compensation. Contact the experienced legal team at Levin & Perconti to discuss your case.
