Plaintiff’s attorney David Berardinelli recently won a law suit allowing him to publish a book later this year, From Good Hands to Boxing Gloves, that will expose All State Insurance Company’s claim evaluation process.

The book discusses the money Allstate saved by hiring McKinsey Consulting company to restructure their claim management procedures. Specifically, claims agents were urged to only pay the minimum necessary to satisfy claims, and play “hardball” with their clients who sought more.

The book will be marketed to attorneys and is expected to be released in the summer, 2006.

In response to states drafting false claims acts that are not at least as strong as the federal False Claims Act, the government is providing an incentive for states to strengthen and pass these laws.

As part of the 2005 Deficit Reduction Act (DRA), the government will provide a 10 percent increase in the state's share of Medicaid fraud recoveries if their laws are at least as strong as the federal False Claims Act.
