Medication Mistake Caused Injury to Nursing Home Resident, Prompted Lawsuit

As people get older they often require prescription medications to treat their medical conditions and to keep their problems from worsening. Most elderly people in nursing homes take at least one prescription medication on a regular basis and many take two or more daily. At nursing homes, residents rely on their caregivers to administer their medications properly.

Unfortunately, this doesn’t always happen. A man recently filed a lawsuit against a nursing home alleging their negligence caused his injuries. The lawsuit was filed in Cook County and seeks damages of more than $50,000.

Medication Errors

Medication mistakes are all too common. There are a number of different ways that errors can occur. The physician may prescribe the wrong medication, or could order the wrong dosage. The pharmacist might make an error when packaging or mixing the medication, or in providing the instructions. Improperly taking the medication can cause serious medical problems. Taking too much medication can cause an overdose while taking too little will not adequately treat the condition. Medical mistakes, including medication mistakes, are the third most common cause of death in the United States.

Coumadin

Coumadin is a medication that is used to thin the blood. The use of Coumadin is very frequent in older individuals. It is prescribed to treat blood clots and to prevent the formation of blood clots. Blood clots such as deep vein thrombosis, DVT, can cause a stroke or heart attack. Coumadin, a brand name type of Warfarin, is an anticoagulant, which keeps the blood from clotting. It is often used after major surgeries, when blood clots are more likely to form. The man in this case was supposed to be taking Coumadin as prescribed by his doctor. According to the lawsuit, the nursing home failed to properly administer the man’s prescription and he was injured as a result.

Failure to Administer Medication

Nursing homes and other care facilities are required to administer a resident’s medication. In this instance, the nursing home failed to provide the man with his prescription medication Coumadin. As a result of their negligence, the man developed DVT, deep vein thrombosis. DVT is a serious condition that causes pain and swelling, and can be life threatening. The failure to administer the man’s prescribed medication resulted in a serious medical emergency, but luckily, the man survived.

Nursing Home Neglect

Nursing homes must provide proper care to their residents at all times. The nursing home in this case was negligent because they did not administer the man’s medication as they should have and the man was injured as a result. In cases such as this, the victim is entitled to damages to cover the medical expenses and pain and suffering that was caused by the negligent action. The man was reportedly not receiving his daily dose of medication, as prescribed by his physician, which is clearly an act of neglect.
