Levin & Perconti Lawsuit Filed Against Nursing Home

A lawsuit has been filed by Levin & Perconti on behalf of the relatives of a man who died after alleged nursing home neglect. The lawsuit, filed in Cook County, names Woodbridge Nursing Pavilion and others stating they knowingly violated the Illinois Nursing Home Care Act. The lawsuit cites the failure to properly supervise and assist the resident, who suffered several medical issues and later died. The suit seeks damages in excess of $50,000 and request for a trial by jury.

Man Suffered Serious Injuries

Nursing home neglect is to blame for serious injuries that the man sustained before his death, according to the lawsuit. The man had fallen several times, suffering bruises and other injuries. He had also developed bedsores, which worsened and contributed to his death. Additionally, the man also was malnourished. His medical condition deteriorated over a period of months, during which time he was likely in quite a bit of pain. These injuries should have been prevented had the facility provided adequate supervision for residents.

· Pressure Ulcers – These painful red sores occur most often when bedding rubs against the skin for an extended period of time. If they are not treated, they can worsen and deepen, becoming infected.
· Falls – Nursing home falls happen to approximately half of all residents at some point in their stay. Falls can cause serious injuries including broken bones, bruises, and severe head trauma.
· Malnutrition – Elderly nursing home residents may not eat properly and often require assistance during meals. When help is not provided, the resident could suffer from malnutrition as well as dehydration.

Nursing Home Neglect

Nursing homes are required by law to provide a safe and healthy environment for elderly people. Sometimes, however, the facility is negligent in the care that it provides. Failing to properly supervise residents while they go about their daily tasks could result in falls or other injuries. Facilities may not have enough people on staff to assist all patients that require it. Additionally, there is often a high turnover of staff and those who are on board may not have received the training needed to care for patients in the correct manner. Management could also be lacking in employee support and structure. These issues could add to the incidence of nursing home neglect or abuse.

Neglect or Abuse

Nursing home neglect occurs when a professional is careless or fails to properly assist or supervise patients. Abuse happens when someone intentionally causes injury to another. Most often, nursing home issues are neglectful, as in this incident. There are times when abuse may have taken place. Deliberately hurting an elderly person could include actions such as pushing someone down, physically restraining a person, or yelling at them. The abuse could be physical or emotional. Both nursing home neglect and abuse are not to be tolerated.
