The son of a nursing home resident who died has filed a lawsuit in Cook County. The lawsuit alleges that the nursing home did not properly supervise the man’s mother, during which time she fell. The woman later died from complications due to the fall. The lawsuit alleges that Friendship Village, in Schaumburg, IL, was negligent and cites a violation of the Illinois Nursing Home Care Act. The man is represented by Levin & Perconti. The woman was a resident of the facility for a period of only four days, during which time the injury occurred.
Negligent Care at Nursing Homes
Neglect in nursing homes is, unfortunately, a common occurrence. Much of the neglect that happens in nursing homes goes unreported. As a family member, it is helpful to continually be aware of the possible signs of abuse or neglect. Some of the common signs of nursing home neglect or elder abuse include:
· Unexplained Bruises · Broken Bones · Behavioral Changes · Depression · Poor Hygiene
Sometimes the resident is unable or unwilling to disclose neglect or abuse. For this reason it is necessary to be vigilant in watching for the potential warning signs. One of the most common injuries is a fall. Falls may be an indication that the resident was not properly supervised or that the staff did not properly assist the resident. In this case, the fall occurred without a staff member or caregiver present.
Falls Can Be Serious
When an older person falls it can have serious medical consequences. Elderly people may heal less quickly than those who are younger. Serious falls can cause broken bones or fractures, which can be difficult to repair. Some broken bones will require surgery, which can lead to complications in those who are older. Additionally, it takes time to heal from a fall, during which time the person may be bedridden. Bedridden patients are subject to many various medical conditions including an increased risk of pneumonia and potential for pressure ulcers. Nursing home falls can and should be prevented and when they are not it may be a sign of nursing home neglect.
Nursing Home Neglect Lawsuit
In this case, the woman died as a result of the injuries she suffered from the fall. After she fell the woman was transferred to a hospital where she was diagnosed with fractured vertebrae. She underwent a surgical procedure, called a hemilaminectomy, to treat herniated discs. After the surgery she suffered complications which led to her death. The lawsuit in this instance is seeking damages in excess of $50,000. Damages may include money for medical procedures such as surgeries and hospitalizations, compensation for pain and suffering, and legal expenses.
