Chicago nursing home lawsuit filed for head trauma caused by fall
A nursing home lawsuit was filed today against the Imperial Grove Pavilion of Chicago for improper nursing care in an injury caused to an 83-year old man. John J. Perconti and Patricia M. Gifford filed the lawsuit on behalf of the family of the man who was a resident of Imperial Grove from August 2005 – May 2006.
When the man was first admitted to the home, he was assessed as a fall risk and noted to need assistance with activities of daily living, including transferring from his wheel chair. The man fell on May 21, 2006 when he was left unsupervised by staff at the home. As a result of the fall, the man suffered a head trauma and was hospitalized with an epidural hematoma. The man was never able to recover from the fall, his condition deteriorating until his death early this year.
The Illinois Department of Public Health cited the facility for improper nursing care and failure to keep residents free from accidents.
Attorney John Perconti blamed the accident on low staffing levels remarking: “Unfortunately falls at nursing homes that result in serious injuries or death are not uncommon in Illinois. This is one of many instances where even though the nursing home was aware of the resident’s fall risk, the home did not protect him because they lacked sufficient staff both in numbers and training.”
